Dai & Associates Wins Appeal in MiMa Tower Litigation

On December 6, 2018, the First Department unanimously ruled in favor of Dai & Associates’ clients in an appeal involving brokerage fees allegedly owed in connection with a $260 million real estate transaction.
Plaintiff Republic Realty alleged that it was owed an approximately $8 million commission on the sale of a bloc of over 140 condominium units at the MiMa Tower in Manhattan. The trial court granted summary judgment for Republic, on the basis that Republic introduced the deal to a potential buyer who, in turn, introduced the deal to the ultimate purchasers.
The First Department unanimously reversed the trial court ruling on multiple grounds, including that there was no privity between Republic and the ultimate purchasers, a group of Chinese real estate developers. The First Department dismissed Republic’s complaint.
